For Respondent : Mr.R.Suresh Kumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.750 of 2023 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/Accused rank not known, apprehending arrest at the hands of the respondent Police for the alleged offence punishable under Sections 379 IPC and Sections 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.750 of 2023 on the file of the respondent Police, seeks anticipatory bail. 1/3

The case of the prosecution is that on 13.06.2023, when the respondent Police was in routine surveillance with regard to illegal sand transportation, the petitioner was found in illegal transportation of 1 unit of river sand in Bolero Pick Up vehicle and the same was recovered by the respondent Police. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent and is no way connected in this case.

4. The learned Government Advocate (Crl.Side) would submit that the petitioner is involved in eight previous cases, among which, two cases are disposed of and three are similar in nature.

5. Considering the facts and circumstance and also considering the bad antecedents of the petitioner, this petitioner is not entitled for any discretionary relief. Hence, this anticipatory bail petition deserves dismissal and accordingly dismissed.
