Respondents PRAYER : Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to direct the respondents to survey the lands in Survey No.160/1, Resurvey No.160/1V to an extent of 24 cents in Kasinathapuram, Karumathur, Usilampatti Taluk, Madurai District on the basis of the petitioner's representation dated 27.08.2018.

ORDER

This writ petition has been filed for the issue of writ of mandamus directing the respondents to act upon the representation made by the petitioner on 27.08.2018, wherein, the petitioner has sought for survey of the subject property.

2. This Court issued notice to the respondents and directed the learned Special Government Pleader to take instructions.

3. When the matter was taken up for hearing today, the learned Special Government Pleader circulated the instructions received from the second respondent dated 02.03.2021, wherein, it is found that https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.20659 of 2018 the second respondent has assigned a detailed explanation and has come to the conclusion that the property cannot be surveyed as sought for by the petitioner.

4. In view of the above development, the relief sought for by the petitioner cannot be granted by this Court. There shall be a direction to the second respondent to communicate the proceedings to the petitioner and the same will enable the petitioner to work out his remedy in the manner known to law. This process shall be completed by the second respondent within four weeks from the date of receipt of a copy of this order.

5. The writ petition is disposed of with the above direction. No costs.
