Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondent to consider the petitioner's representation dated 25.07.2018 for issuance the corrected passport by changing the entry of the petitioner's date of birth as 25.05.1982 instead of 17.07.1980.

ORDER

Heard the learned counsel for the writ petitioner and the learned Assistant Solicitor General of India appearing for the respondent.

2. The petitioner was issued with a passport on 17.12.1998. His date of birth is mentioned as 17.07.1980 therein. He wants it to be altered as 25.05.1982. In support of his contention, the petitioner is having the birth certificate. Therefore, there does not appear to be any major difficulty. In any event, the respondent has to take a call in the matter.

The respondent is directed to consider the petition mentioned representation and pass final order in accordance with law within a period of eight (8) weeks from the date of receipt of a copy of this order. If the petitioner has to leave India before the said time period, the petitioner can as well leave with the existing passport and the respondent will not insist on surrender of the petitioner's passport.

4. This Writ Petition is disposed of accordingly. There shall be no order as to costs.
