ORDER : The Court made the following order :- The petitioner / Accused, who was arrested and remanded to judicial custody on 1/3

06.09.2024 for the offences punishable under Sections 191(2), 191(3), 140(1), 103(1) of BNS and Section 3 of TNPPDL Act in crime No.318 of 2024 on the file of the respondent police, seeks bail.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent and perused the materials available on record.

The learned counsel for the petitioner would vehemently contend that since the FIR is very categorical and it is only naming some other six persons and the petitioner's name was not even being mentioned in the FIR. Only on the basis of the confession of the co-accused, the petitioner name is falsely implicated in this case. Further, the petitioner is languishing in prison from 06.09.2024 and seeks bail.

4. Considering the submission made on behalf of the prosecution that the petitioner was also in the vehicle which came to light only subsequently and that the investigation in the nascent stage, for the present I am not inclined to enlarge the petitioner on bail.
