Petition filed praying that in the circumstances stated therein and in the affidavit filed therewith the High Court may be pleased to issue of Writ of Certiorarified Mandamus calling for the records relating to the impugned order passed by the 2nd respondent in his proceedings in e.f.vz;.54755/r2/,1/2022 dated 01.11.2022 and quash the same as illegal and consequently to direct the respondents to restore the petitioners as Deputy Inspectors in conformity with the common order dated 25.03.2022 made in W.A.(MD).No. 255 of 2022 on the file of this Honble Court and to conduct counseling thereafter considering the petitioners as Deputy Inspectors within the period that may be stipulated by this Honble Court.
ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.M.AJMAL KHAN, Senior Counsel Assisted by MRS.MOHAMED SUHAIL, Advocate for M/S.AJMAL ASSOCIATES for the petitioners and of MR.J.ASHOK, Additional Government Pleader on behalf of the Respondents, the court made the following order:- The matter is listed today under the caption "Separate Court Fee not paid cases" in view of the non-compliance observed by the Registry.
2. This Court has ordered the miscellaneous petition in W.M.P(MD).No.19198 of 2022 directing the petitioners to pay separate Court fee. However, it is brought to the notice of this Court that Separate Court Fee has not been paid by the petitioners till today. Hence, the learned counsel for the petitioners is directed to comply with the non-compliance pointed out by the Registry on or before 28.02.2023 and file proof of compliance, failing which, the order passed by this Court on 03.11.2022 in W.P(MD).No.25101 of 2022 would be applicable only to the case of the first petitioner and would not enure to the benefit of the other petitioners in consonance with the amendment made to the Court Fee Rules. sd/- 14/02/2023 / TRUE COPY / 16/02/2023 Sub-Assistant Registrar (C.S.)
