When the Writ Petition is taken up for hearing, the learned Counsel for the petitioner would submit that after notice was ordered by this Court for the appearance of the Revenue Divisional Officer, the petitioner was informed that his appeal has been allowed.

The learned Counsel, however, expressed certain apprehension, as to whether the parties to the lis had been properly heard and opportunity given.
