PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.329 of 2023 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused rank not known, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 454, 457, 380 IPC, in Crime No.329 of 2023 on the file of the respondent Police, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant is the owner of 1/4
fire works company. The District Revenue Officer has suspended the license due to lincense violation, so the factory was closed down. On 13.08.2023 the defacto complainant went to the factory premises to verify the stock, he found that the finished fire crackers worth about Rs.60,000/- is missing. Hence, the complaint.
3. The learned counsel for the petitioner would submit that the petitioner is ready to deposit the remaining amount of cost of crackers namely Rs.50,000/-.
4. The learned Government Advocate (Crl. Side) for the respondent Police submitted that the petitioner is involved in eight previous cases, among which, most of the cases are registered for petty offences. According to him, out of eight cases, six cases ended in acquittal.
5. Considering the facts and circumstances of this case and also considering the above said proposal that the petitioner is ready to deposit Rs.50,000/-, this Court is inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this Criminal Original Petition is allowed on condition that the petitioner shall deposit a sum of Rs.50,000/- (Rupees Fifty Thousand only) to the credit of Cr.No.329 of 2023 before the trial Court concerned. On such deposit being made, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, before the learned Judicial Magistrate No.II, Sivakasi, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand 2/4
only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall appear before the respondent police daily at 10.30 a.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. sd/- 27/09/2023 / TRUE COPY / /10/2023 Sub-Assistant Registrar (C.S.)
