O R D E R This Criminal Original Petition is filed to direct the 1st respondent to depute any other investigation agency to investigate the case in Crime No.46 of 2023 on the file of the 2nd respondent.
2. When the matter was heard on 17.10.2023, grievance that was expressed by the petitioner is that the second respondent is not willing to receive the documents, which are available with the hands of the petitoner. Direction was issued to the third respondent herein to receive th documents and investigate the matter on that line.
3. In pursuance of the above said direction, now the learned Government Advocate (Crl.Side) would submit that the documents have been received from the petitioner and alteration report is filed altering the offence to under Sections 147, 148, 294(b), 323 and 506(ii) IPC.
4. Now the grievance of the petitioner is that the offence under Section 307 IPC is purposefully omitted in the alteration report.
5. But such sort of contentions cannot be expressed at this stage. It is the matter of investigation. Even though the learned counsel for the 2/4
petitioner has made out his grievance to some extend, I find absolutely no reason to transfer the investigation. Let the above said investigation be completed within a period of three months from date of receipt of copy of this order. If the petitioner is aggrieved over the outcome of the above said investigation, he can workout his remedy through appropriate proceedings, thereafter.
6. With the above said direction and liberty, this Criminal Original Petition is dismissed.
