O R D E R

This Criminal Original Petition has been filed seeking direction to the learned Judicial Magistrate No.I/ Fast Track Court, Magistrate Level, Madurai to complete the case in S.T.C.No.714 of 2016 within a stipulated time as fixed by this Court.

2. The crime is of the year 2013 and the final report was filed in the year 2013 and the same was taken on file in S.T.C.No.714 of 2016 on the file of the learned Judicial Magistrate (Fast Track Magistrate Level), Madurai. Without any progress, the case is pending for the past 7 years. Hence, the present petition has been filed.

3. On 11.10.2023, this Court directed the registry to call for the report with regard to the stage of the said case and reason for the delay in disposing the case.

4. Today, a report has been received from the concerned Court below and it was stated that the complainant died and so far his legal heirs are not brought on record. Therefore, the case was repeatedly adjourned. No proper application has been filed by his legal heirs to prosecute the case.

5. In view of the above, this Criminal Original Petition is disposed of with a direction to the learned Judicial Magistrate (Fast Track Magistrate Level), Madurai to dispose of the case in S.T.C.No.174 2/4

of 2016 as per procedure within a period of one month from the date of receipt of copy of this order.
