ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences under Sections 406, 468, 471, 420, 120(B), 294(b) and 506(i) of IPC, in Crime No.25 of 2024 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the accused persons had received a total sum of Rs.72,87,900/- from the defacto complainant on the ground that the defacto complainant is going to be made as a partner.

3. Heard the learned counsel on either side and perused the materials placed on record.

4. Considering the nature of dispute involved in this case, the parties were referred to the mediation centre. They were not able to reach any settlement and therefore, the matter has been sent back to this Court.

5. Taking into consideration the facts and circumstances of the case and also 2/4

the fact that the entire case is now borne out by records, there shall be direction to the respondent police to resort to Section 35 of the BNSS Act and the investigation shall be completed within a period of 3 months.

6. Considering the fact that the case involves a money dispute, immediate arrest need not be resorted to and the procedure under Section 35 of the BNSS can be followed.
