ORDER
This writ petition has been filed for a Mandamus to direct the 1st respondent to issue Passport to him considering his application dated 30.09.2024.

The facts as set out in the affidavit filed in support of the writ petition are as follows:- The petitioner would submit that he had submitted his application on 30.09.2024 and also attended the interview based on the appointment time and date allotted. Thereafter, he had received an adverse report from the 1st respondent regarding criminal antecedent. The adverse report was provided by the 2nd respondent based on the registration of FIR against the petitioner under Section 379 of IPC read with 21(1) of the Mines and Minerals Act in Crime No.14 of 2023. The petitioner had submitted an explanation vide his letter dated 21.08.2025. However, the same has not been considered to date and he has not been issued with passport. Therefore, he is before this Court.

3. When the matter has come up on 09.09.2025, this Court had directed the 2nd respondent to inform the Court as to whether a charge sheet has been filed. Today when the matter is called, the 2nd respondent produced a copy of the FIR as also the Final Report and submitted that the same has been taken on file in C.C.No.665 of 2025 on the file of the Judicial Magistrate II Kumbakonam. The matter is pending summons. The case was taken on file on 09.09.2025 and the next date of hearing was on 05.11.2025.

In the light of the above and considering the provisions of Section 6(2)(f) of the Passport Act, the petitioner has to await the result of the investigation and thereafter, renew his application subject to the provisions of the Passport Act. The writ petition is therefore dismissed as the petitioner has not made out any case for issue of passports pending the investigation. No costs.
