Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing respondent Nos.3 to 6 to take appropriate steps to issue look out notice as against respondent Nos.7 and 8 who are absconding and evading from the clutches of law through respondent No.1 and further directing the second respondent to enquire the seventh and eighth respondents for having obtained illegal passport by considering the petitioner's written representation dated 20.10.2022. O R D E R

This Writ Petition has been filed for issuance of Writ of Mandamus directing respondent Nos.3 to 6 to take appropriate steps to issue look out notice as against respondent Nos.7 and 8, who are absconding and evading from the clutches of law through respondent No.1 2/6

and further directing the second respondent to enquire the seventh and eighth respondents for having obtained illegal passport by considering the petitioner's representation dated 20.10.2022.

2. The learned counsel appearing for the petitioner would submit that the petitioner made a complaint as against the seventh and eighth respondents before the fourth respondent Police and thereafter, the fourth respondent Police registered a case in Crime No.566 of 2021 for the alleged offence punishable under Sections 147, 120(B), 294(b), 448 and 506(i) IPC. Since respondent Nos.7 and 8 are absconding, the investigation is pending without any progress and therefore, the petitioner made a representation to respondent Nos.3 to 6 on 20.10.2022 to issue Look Out Notice. Since no action has been taken by the respondent Nos.3 to 6, the present petition has been filed.

3. The learned counsel appearing for the petitioner would submit that this Court may issue a direction to respondent Nos.3 to 6 to consider the representation made by the petitioner dated 20.10.2022. 3/6

4. The learned Additional Public Prosecutor appearing for the respondent Police would submit that the petitioner's representation will be considered and appropriate orders will be passed within the time limit fixed by this Court.

5. In view of the above, this Court without expressing any opinion on the merits of the matter, directs the respondent Police to consider the petitioner's representation dated 20.10.2022 and pass appropriate orders in accordance with law.

6. With the above direction, this Writ Petition stands disposed of. No costs.
