PRAYER :- For Bail in Crime No. 265 of 2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/Sole Accused herein, who was arrested on 06.09.2023 for the alleged offence under Sections 294(b), 353, 307, 506(ii) of IPC in Crime No.265 of 2023, on the file of the respondent police, seeks bail. 1/3
2.The case of the prosecution is that on 05.09.2023, when the respondent police on regular patrolling duty, the petitioner standing in suspicious manner near the Vellimalai Esakkiamman Temple, Manaipadaiveedu to Palayamkottai Road. When the respondent police enquired the petitioner, he abused them in filthy language, showing the sickle, tried to assault them and threatened them with dire consequences. Hence, the case was registered. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution.
4.The learned Additional Public Prosecutor submitted that the final report is made ready and will be filed before the concerned Court shortly. There is no injury in this case.
5.Considering the period of incarceration and only as a preventive measure this case has been registered, this Court is inclined to grant bail to the petitioner with stringent conditions.
6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.III, Tirunelveli and on further condition that the 2/3
petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
