Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Declaration, declaring that the petitioner has a statutory charge over the compensation amount that may be awarded by the first respondent for acquiring the property in Survey No.128/1 and Survey No.132/1A, Achunthanvayal Village, Ramanathapuram District, payable to the respondents 2 to 9 and consequently, directing the first respondent to disburse a sum of Rs.11,00,000/- (Rupees Eleven Lakhs only) paid by the petitioner to the respondents 2 to 9 as advance amount towards the said agreement dated 12.05.2016 from and out of the compensation amount payable to the respondents 2 to 9.

ORDER

This Writ Petition has been filed seeking issuance of a Writ of Declaration declaring that the petitioner has a statutory charge over the compensation amount that may be awarded by the first respondent for acquiring the properties in Survey No.128/1 and Survey No.132/1A, situated at Achunthanvayal Village,

Ramanathapuram District, payable to the respondents 2 to 9 and, consequently, directing the first respondent to disburse a sum of Rs.11,00,000/- (Rupees Eleven Lakhs only), paid by the petitioner to the respondents 2 to 9 as advance amount towards the agreement dated 12.05.2016, from and out of the compensation amount payable to the respondents 2 to 9.

The petitioner has also filed W.P.(MD)No.24908 of 2023 seeking a direction to the District Collector, Ramanathapuram, to direct the Special Tahsildar, NH-49, Ramanathapuram, not to grant compensation for the acquisition of the property in S.No.128/1 and S.No.132/1A2 to the respondents 2 to 9 herein till the final verdict in terms of the Lok Adalat Award dated 19.12.2019 in O.S.No.41 of 2017, on the file of the Principal District Court, Ramanathapuram, by considering the petitioner's representation dated 04.09.2023.

3. This Court, by order dated 01.11.2023, disposed of the said Writ Petition directing the Special Tahsildar, NH-49, Ramanathapuram, to pass orders on the petitioner's objection/representation.

4. Since the grievance of the petitioner is in respect of the Lok Adalat Award passed in relation to the acquired property, and in view of the orders passed in W.P.(MD)No.24908 of 2023 dated 01.11.2023, the cause in the present Writ Petition does not survive. Hence, the Writ Petition is dismissed. No costs. Consequently, the connected Miscellaneous Petition is closed. NCC : Yes / No (K.SURENDER, J.)
