RESPONDENT/RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to suspend the sentence in CRL.A.(MD) No.330 of 2019 in S.C.No.260 of 2013 dated 28.06.2019 by the III Additional District Sessions Judge, Pattukottai and enlarge them on bail pending disposal of the above appeal Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.T.SEKAR, Advocate for the petitioner and of Mr.R.ANANDHARAJ, Additional Public Prosecutor on behalf of the Respondent the court made the following order:- (Order of the Court was made by T.RAJA.J) This petition has been filed seeking suspension of substantive sentence of imprisonment imposed on the petitioner/appellant in S.C.No.260 of 2013, dated 28.06.2019, by the learned III Additional District and Sessions Judge, Pattukkottai and enlarge him on bail, pending disposal of appeal.
2.On perusal of records, it is seen that this Court has already rejected the request of the petitioner for suspension of sentence by https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL MP(MD) No.10048 of 2019 an order dated 16.08.2019. In the said order, this Court has also directed the Registry to list the appeal for final disposal on 30.09.2019.
3.In view of the earlier order of this Court and also considering the fact that this matter is ready for final hearing, we are not inclined to entertain this petition.
4.Accordingly, this miscellaneous petition is dismissed. The Registry is directed to post this matter for final hearing, after the typed set is made ready.
