ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 09.08.2025 for the offences punishable under Sections 194 of BNSS, 108, 211 and 238 of BNS Act, in Crime No.94 of 2025 on the file of the respondent police. seeks bail.
2.The case of the prosecution is that the Petitioner is the husband of the deceased Narmathadevi. The 2nd accused is the mother of the 1st accused. After the marriage between the deceased and the Petitioner, he had harassed the deceased. The Defacto complainant who is the elder sister of the deceased had pacified her. After birth of a female child, the deceased was subjected to be abused physically and mentally. When the parents of the deceased questioned about such harassment, the accused had demanded Rs.10,00,000/- and a car. On 17.06.2025, the deceased was in her parents' house and she committed suicide on 17.06.2025 at about 04.30 a.m. Without informing the death of the deceased either to the police or to the other Government Officers they had taken the body to the native of the accused and they have completed the cremation by burnt her body. On 18.06.2025 when the De-facto complainant came to aware 2/8
of the video sent by the deceased to the relatives, she had lodged the complaint. Hence, the complaint.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case. He further submitted that the petitioner is ready and willing to abide by any stringent conditions that may be imposed by this Court. He also further submitted that the petitioner is in custody from 09.08.2025. Hence, he seeks bail.
4.The learned Additional Public Prosecutor submitted that the Petitioner is the husband of the deceased Narmathadevi. The 2nd accused is the mother of the 1st accused. 5. The learned counsel for the Intervenor/defacto complainant submitted that the petitioner and his mother had demanded additional dowry from the deceased and harassed her, due to which, she had committed suicide. Hence, he vehemently opposed for grant of bail to the petitioner.
6. Taking into consideration of the facts and circumstances of the case and also the fact that the petitioner has complied with the condition as imposed by this Court dated 04.09.2025. Hence, the interim bail 4/8
already granted to the petitioner dated 04.09.2025 is confirmed, subject to the following conditions:
[a] the petitioner shall report before the respondent police daily at 10.30 a.m.,until further orders.
[b] the petitioner shall not abscond either during investigation or trial.
[c] the petitioner shall not tamper with evidence or witness either during investigation or trial. [d] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
[e] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
