ORDER

(Order of the Court was made by S.S.SUNDAR, J.) Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the respondent - Bank.

2. This Writ Petition is filed seeking for issuance of a Writ of Mandamus, directing the respondent to accept the One Time Settlement (OTS) offer made by the petitioner and to consider the petitioner's representation regarding the OTS proposal, dated 29.06.2023.

However, it seen that challenging the order passed by the Chief Judicial Magistrate, earlier the petitioner has filed a writ petition in W.P(MD)No.12465 of 2022, wherein this Court vide order, dated 01.09.2023, directed the petitioner to deposit a sum of Rs.5,00,000/- on or before 25.09.2023 and to deposit a sum of Rs.6,00,000/- per month further from the month of October, 2023. Thereafter, the petitioner has filed the present writ petition with the aforesaid prayer.

4. In view of the order passed by this Court in the earlier writ petition in W.P(MD)No.12465 of 2022, dated 01.09.2022, this Court is unable to entertain this writ petition.

5. However, the petitioner is permitted to file an application in W.P(MD)No.12465 of 2023, either for modification of the order or for extension of time granted by this Court.

6. With the above observation, this writ petition is dismissed. No Costs.
