PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the second respondent to measure survey No.58/1A1A and survey No. 58/1A1B of Pudukkottai Village, Manapparai Taluk, Tiruchirappalli District and issue separate patta for 1/6 share in the name of the petitioner's father, namely Sannappareddy based on the petitioner's representations, dated 29.02.2024 and 24.05.2024. This Writ Petition has been filed seeking a direction to the second respondent to conduct a survey in the property in S.Nos.58/1A1A and 58/1A1B at Pudukkottai Village, Manapparai Taluk, Tiruchirappalli District and issue separate patta for 1/6th share in the name of the petitioner's father, namely Sannappareddy 2/5

2.The grievance of the petitioner is that the applications, dated 29.02.2024 and 24.05.2024, seeking to conduct a survey on his property has not been considered by the official respondents. 3.The learned Additional Government Pleader takes notice for the respondents 1 and 2 and submits that the subject property is in joint patta. Therefore, the respondents 1 and 2 have to issue notice to the other pattadhars and receive objections if any raised by them. Only thereafter, survey would be conducted.

4.The petitioner has submitted the applications on 29.02.2024 and on 24.05.2024. It is not proper on the part of the respondents 1 and 2 keeping the applications pending without passing any order. In the event if it is a joint patta, it is open to the respondents 1 and 2 to issue notice to the other pattadhars and receive objections if any. If the petitioner is having any extent of patta, that extent can be identified, the same can be surveyed and boundaries can be marked.

5.The said exercise shall be completed within a period of four months from the date of receipt of a copy of this order. 3/5

6.With the above direction, this writ petition stands disposed of. No costs.
