ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 417, 376 and 506(i) IPC and Section 5(1) r/w. 6 of POCSO Act, in Crime.No.179 of 2024, seeks anticipatory bail.

2. Heard the learned counsel for the petitioner and the learned Government 1/3

Advocate (Crl. side) appearing for the respondent Police and perused the materials available on record.

The learned counsel for the petitioner would submit that this court should take into account the long standing relationship between the parties and they were in relationship over a period of nine years and even after the girl became 18 years of age there was no complaint whatsoever which will disclose that it was nothing but an act of consent. Be that as it may, when the statement is made by the prosecutrix that there was a physical relationship and considering the fact that earlier twice the anticipatory bail petitions have been dismissed, this is not a fit case for enlarging the petitioner on anticipatory bail.

4. Accordingly, the Criminal Original Petition is dismissed.
