O R D E R

After obtaining a decree in O.S.No.31 of 2016 on 28.02.2017, the petitioner requested the second respondent to cancel the patta No.1339 standing in the name of the fourth respondent. Since such request has not been considered and disposed of as on date, the present Writ Petition is filed.

2. Learned Additional Government Pleader accepts notice on behalf of respondents 1 to 3. He submits that the inquiry would be concluded and a decision would be taken within eight weeks from the date of receipt of a copy of this order.

3. The petitioner has placed on record the Judgment and Decree dated 28.02.2017 and the inquiry notice dated 25.06.2021 from the 2/5

second respondent. While the petitioner asserts that no appeal has been filed by the fourth respondent, this aspect has to be verified after putting the fourth respondent on notice in the pending inquiry.

4. Accordingly, without expressing any opinion on the merits of the matter, the second respondent is directed to complete the inquiry relating to the request for cancellation of the patta after providing a reasonable opportunity to the petitioner and the fourth respondent. An order shall be issued within eight weeks from the date of receipt of a copy of this order. In view of the nature of the direction, the Writ Petition is disposed of without notice to the fourth respondent. 5.With the above direction, this Writ Petition stands disposed of. No costs.
