Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.VETRIVEL.B, Advocate for the petitioner and of Mr.R.SURESH KUMAR, Government Advocate(Crl.side) on behalf of the Respondent and Mr.K.

This Criminal Miscellaneous Petition has been filed to modify the condition No.11 passed by this Court in Crl.O.P(MD) No.14588 of 2023 dated 18.08.2023 2.Heard the learned counsel appearing for the petitioner, the learned Government Advocate(Crl.side) appearing for the respondent and the learned Counsel appearing for the defacto complainant. 3.Considering the facts and circumstances of the case, the condition no.10 directing the second petitioner to deposit a sum of Rs.50,000/- to the credit of Crime No.292 of 2023 before the learned Magistrate, Murisi shall stand deleted. Since Para.10 is deleted the condition directing the defacto complainant to withdraw the amount deposited by the second petitioner before the trial Court in Crime No.

292 of 2023 without awaiting for the result of this case is also deleted and the defacto complainant is directed to file an appropriate petition before the concerned trial Court seeking for interim custody of the vehicle. Further time to comply with the conditions imposed by this Court is extended by two weeks from the date of receipt of a copy of this order. All other conditions shall remain unaltered.
