RESPONDENT/COMPLAINANT Criminal Original Petition filed praying that in the circumstances stated therein and in the affidavit filed therewith the High Court may be pleased to set aside the order passed against the petitioner in Crl.M.P.No.4784 of 2023 dated 15.09.2023 on the file of the learned Principal District and Sessions Judge, Virudhunagar at Srivilliputhur.

ORDER : This Criminal Original petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.I.SUTHAKARAN, Advocate for the petitioner and of Mr.R.SURESH KUMAR, Government Advocate(crl.side) on behalf of the Respondent, the court made the following order:- This petition has been filed to set aside the order passed against the petitioner in Crl.M.P.No.4784 of 2023, dated 15.09.2023 on the file of the Principal District and 1/3

Sessions Judge, Virudhunagar at Srivilliputhur.

2. The learned counsel for the petitioner would submit that by the order dated 14.08.2023 in Crl.M.P.No.4022 of 2023, the order has been passed by the Principal District and Sessions Judge, Virudhunagar at Srivilliputhur, imposing Rs.2,00,000/- as cost upon the petitioner. Since, the petitioner is very poor, he could not comply the above said condition. Hence, he seeks modification to the above said condition. 3.Taking into consideration of the submissions made by the learned counsel for the petitioner, the condition No.1 imposed by the learned Principal District and Sessions Judge, Virudhunagar at Srivilliputhur, in Crl.M.P.(MD) No.4022 of 2023, dated 14.08.2023 is modified to the effect that the petitioner is directed to deposit a sum of Rs.10,000/- to the District Mediation Centre, Virudhunagar District at Srivilliputhur, instead of Rs.2,00,000/-. Hence, this Criminal Original Petition is ordered.
