For Respondent : Mr.M. Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.437 of 2010 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who is arrayed as Accused No.1 in Crime No.437 of 2010, on the file of the respondent police, apprehends arrest at the hands of the respondent police, for the alleged offences punishable under Sections 294(b), 323, 324, 307 along with Section 34 of IPC, which is now pending in S.C.No.51 of 2016 on the file of the learned Chief Judicial Magistrate, Pudukkottai and hence, seeks anticipatory bail.

2.The case of the prosecution is that the due to previous enmity, the petitioner along with other accused picked up quarrel with the defacto complainant and abused with filthy language and https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.19731 of 2022 attacked and threatened him with dire consequences. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. Hence, he prays for anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent police would submit that after completion of investigation of the case in Crime No.437 of 2010, the respondent police has filed the final report before the Court concerned and the same was taken on file as S.C.No.51 of 2016. Due to absence of the petitioner, Non Bailable Warrant was issued as against the petitioner on 09.02.2022. He would further submit that the petitioner is absconding continuously and the case is pending before the Court concerned without any progress because of the pendency of Non Bailable Warrant against the petitioner. Therefore, he prays for dismissal of the petitioner.

5.Considering the facts and circumstance of the case and also considering the fact that the petitioner is absconding continuously, this Court is not inclined to grant anticipatory bail to the petitioner.
