PRAYER :- For Bail in Crime No.109 of 2023 on the file of the respondent police. 1/4

ORDER : The Court made the following order :- The petitioner/Accused herein, who was arrested on 18.07.2023 for the alleged offence under Sections 302 of IPC altered into Sections 302 and 379 of IPC, in Crime No.109 of 2023, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the defacto complainant's father Muthusamy died some years prior to the occurrence. His maternal grand mother, mother and his brother were living together in Kadavoor Taluk. On 18.07.2023, the defacto complainant came to know that his mother was found dead in the occurrence place. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. 4.The learned Additional Public Prosecutor submitted that this petitioner has received gold chain belongs to the deceased and pledged the same in a finance company. Investigation has been completed and charge sheet is made ready, going to be filed before the concerned court shortly.

5. Considering the facts and circumstances of this case and also the fact that charge sheet has been made ready and also considering the period of incarceration, this Court is inclined to grant bail to the petitioner with certain conditions.

6. Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.1, Karur, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
