Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the 2nd respondent to issue patta in the name of Arulmigu Sri Akora Veerapathirar Thirukovil, situated at Old Survey No.106/4A, New Survey No.403/1, at Natham, Natham Taluk, Dindigul District, to the extension of 0.03.80 Hectare within a time frame that may be stipulated by this Court.

ORDER

This writ petition is filed to direct the 2nd respondent to issue patta in favour of Arulmigu Sri Akora Veerapathirar Thirukovil in respect of the property in Old S.No.106/4A, New S.No.403/1, measuring to the extension of 0.03.80 Hectare, situated at Natham, Natham Taluk, Dindigul District.

2.According to the petitioner, with the relief sought for in the prayer, he made a representation dated 25.09.2018, to the respondents. So far, no action has been taken. Hence, the petitioner is before this Court.

3.In reply, the learned Special Government Pleader appearing for the respondents would submit that the petitioner's representation dated 25.09.2018 has not been considered for the reason that he has not furnished "No Objection Certificate" for the relief stated supra from the Natham Town Panchayat. If the petitioner submits "No Objection Certificate", his representation dated 25.09.2018, would be considered on merits and in accordance with law.

4.Recording the submission made by the learned Special Government Pleader, this Court is inclined to pass the following direction:- the 2nd respondent is directed to serve notice to the https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.21153 of 2018 petitioner, asking him to produce the "No Objection Certificate" from the Natham Town Panchayat and if the petitioner submits the same, the 2nd respondent is directed to consider the petitioner's representation dated 25.09.2018 and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order; 5.It is make it clear that this Court is not appreciating the respondents for pending such type of representations, without informing the cause to the petitioner, for a period of more than 2 years. Therefore, the respondents have to strictly comply with the orders of this Court for disposal of such type of representations, without being unnecessarily pending for years together. 6.With the above direction, this Writ Petition is disposed of. No costs.
