C.M.P.(MD) Nos.14412, 14413 & 14415/2025 in S.A.(MD)No.32 of 2024 K.MURALI SHANKAR,J.

The above petitions have been filed (i) to condone the delay of 169 days in filing the petition to set aside the abatement caused due to the death of the appellants 1 & 2 (ii) to set aside the abatement caused due to the death of the appellants 1 & 2 and (iii) to bring on record the petitioners 4 to 6 legal representatives of the deceased appellants 1 and 2 and rank them as proposed appellants 4 to 6 in the above second appeal.

2.The learned counsel for the petitioners would submit that the second appellant is the son of the first appellant and since both appellants died, the legal representatives of the deceased second appellant are to be impleaded in the second appeal.

3.The learned counsel appearing for the respondents would submit that they are not having any objection in allowing these petitions.

4.Records perused. Being satisfied with the reasons stated in the affidavit filed in support of these petitions, these petitions are ordered and the Registry is directed to carry out necessary amendment in the second appeal and list the matter on 05.01.2026.
