PRAYER :- For Bail in Crime No.186 of 2022 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to Judicial Custody on 10.07.2022 for the offences punishable under sections 8 (c) r/w. 20(b)(ii)(C) and 25 of NDPS Act, 1985 in Crime No.186 of 2022 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner and other accused have illegally found in possession of 21.500 kgs of Kanja. Hence, the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his names has been falsely implicated in this case. He would further submit that the petitioner is not having any previous case and he is in judicial custody from 10.07.2022 and seeks bail.

CRL OP(MD). No.19713 of 2022 4.The learned Government Advocate (Crl. Side) appearing for the respondent would submit that totally five accused involved in this case and the petitioner herein is arrayed as A5. He would further submit that the petitioner and other accused have illegally found in possession of 21.500 kgs of Kanja and the contraband recovered from the petitioner is 10 kg 500 gms and he is a seller of Kanja. He would further submit that the investigation of the case was completed and the charge has been filed before the concerned Court. Considering the gravity of offence he strongly opposed grant bail to the petitioner.

5.Considering the facts and circumstances of the case and also considering the gravity of offence and that the petitioner herein is the main accused, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal Original Petition is dismissed.
