PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondent Nos.1 and 2 herein to provide necessary police protection for fencing the petitioner's property in S.No.279/9 situated at Kuppichipalayam Village, Vangal Post, Manmangalam Taluk, Karur District, by considering the petitioner's representations, dated 27.08.2023 and 28.08.2023.

This petition is filed under Article 226 of the Constitution of India seeking for a direction to the respondent Police to provide necessary police protection for fencing his land in S.No.279/9, situated at Kuppichipalayam Village, Vangal Post, Manmangalam Taluk, Karur District, basing on the decree stated to have granted by the Civil Court in favour of the petitioner.

It is submitted by learned Senior counsel for the petitioner that he has filed O.S.No.993 of 1994 on the file of the learned Principal District Judge, Karur, seeking for permanent injunction against the father of respondent No.3 and others and after fullfledged trial, the said relief stated to have been granted by the trial Court and it has become final. It is submitted that the petitioner intended to survey the land when there was an obstruction from the unofficial respondent, the petitioner has filed W.P.(MD).No.11238 of 2023 and as per the directions of this Court, the survey was also conducted with the Police protection. Now, it is submitted that in spite of after completion of the survey when the petitioner intended to fence the land, the unofficial respondent is trying to intervene, thereby, he filed an application for police protection. However, the respondent Police are not responding. 2/4

3. Learned Government Advocate (Criminal Side) submits that the representation of the petitioner is numbered as C.S.R.No.426 of 2023 and enquiry is being initiated and requested time to complete the enquiry.

4. In view of the submissions made by both sides, this petition is disposed of, directing the respondent Police to dispose of the representation of the petitioner for providing Police protection as quickly as possible not later than two weeks from the date of receipt of a copy of this order.
