For Respondent : Mr.E.Antony Sahaya Prabahar, Government Advocate (Crl.Side) PETITION FOR BAIL Under Sec.438 of Cr.P.C PRAYER :- For Bail in Cr No.327/2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to Judicial Custody on 28.10.2022 for the offences punishable under section 294 (b), 324 and 506(ii) @ u/s. 294(b), 324, 506(ii) and 307 IPC in Crime No.327 of 2022 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that due to wordy quarrel arose between the parties, the petitioner has attacked the defacto complainant with Aruval and repeatedly cut the left fingers and caused grievous injuries and also abused him in filthy language. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his names has been falsely implicated in this case. He would further submit that the petitioner is in judicial custody from 28.10.2022 and seeks bail. https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.19723 of 2022 4.The learned Government Advocate (Crl. Side) appearing for the respondent would submit that originally a case was registered under Section 506(ii) IPC and subsequently @ 307 IPC. He would further submit that since petitioner attempted the life of the defacto complainant by using Aruval and that the investigation of the case is pending, he strongly opposed grant bail to the petitioner.

5.Considering the facts and circumstances of the case and also considering the gravity of offence and that the investigation of the case is pending, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal Original Petition is dismissed.
