THE HONOURABLE MS.JUSTICE P.T.ASHA Tr.C.M.P.(MD) No.515 of 2019 and C.M.P.(MD) No.11932 of 2019 R.Manikandan .. Petitioner -vsR.Swathika Devi .. Respondent Prayer :- Petition filed under Section 24 of Code of Civil Procedure, to withdraw the HMOP No.918 of 2015 on the file of the Family Court, Madurai and to transfer to Family Court, Sivagangai. For Petitioner : Mr.K.Shanmugaraja For Respondent : Mr.J.Barathan for Mr.T.R.Jeyapalam
ORDER
The learned counsel for the petitioner would submit that this transfer civil miscellaneous petition has become infructuous, considering the fact that the only allegations on which the transfer is sought for was that the Presiding Officer was favourably disposed towards the respondent and there was a chance of the HMOP going in favour of the respondent. Now, the Judicial Officer is changed. Therefore, nothing survives for consideration in this Transfer Civil Miscellaneous Petition.
2.In view of the above submission, this Transfer Civil Miscellaneous Petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
