This case came up for settlement before the Lok Adalat. Both the parties present. The counsel for the appellant/s Mr.M.Sridharan and the counsel for the respondent/s Mr.J.Jeyakumaran are present. After mutual discussion, negotiation, mediation and conciliation between both parties and with the assistance of the Bench, both sides consented for settlement. 1/3
AWARD Both the parties are present. After due deliberation, they are agreed to settle the case for a sum of Rs.11,75,000/- (Rupees Eleven Lakhs and Seventy Five Thousand only) as full and final settlement. The appellant/defendant is agreed to pay the above said amount as full and final settlement of the decree passed in O.S.No.30 of 2017 within a period of 60 days from the date of receipt of copy of this order, failing which, the decree passed by the trial Court in O.S.No.30 of 2017 shall stand confirmed. The respondent/plaintiff is also agreed to receive the above amount Rs.11,75,000/- (Rupees Eleven Lakhs and Seventy Five Thousand only) as full and final settlement of the above decree.
2. On payment of the above said amount, the respondent/plaintiff is agreed to execute a deed of cancellation of mortgage at the expenses of the appellant/defendant.
The Court fee paid shall be refunded to the parties in the manner provided under the Court Fees Act 1870, as provided for under Sub Section 1 of Section 21 of the LSA Act 1987as amended in 1994. The original of the award shall be placed in the Court record and copy of the award shall be kept with High Court Legal Service Committee and one copy each is furnished to both parties free of cost. In agreement of the above, both parties and their counsel have affixed their signature/ thump impressions in presence of the Lok Adalat Bench admitting the terms and conditions and accordingly.
