ORDER
This Criminal Miscellaneous Petition has been filed to grant further time to file a protest petition before the Judicial Magistrate Court No.IV, Thoothukudi, in 1/5
compliance of the order, dated 26.02.2025 passed by the Co-ordinate Bench of this Court in Crl.R.C.(MD)No.1299 of 2024.
2.Heard Mr.M.P.Senthil, learned Counsel for the petitioner and Mr.M.Karunanithi, learned Government Advocate (Crl.side) for the respondent. 3.The Co-ordinate Bench of this Court, vide order, dated 26.02.2025, in Crl.R.C. (MD)No.1299 of 2024, passed the following order: "14.In the result, this Criminal Revision Case is allowed and the impugned order dated 25.09.2024 taking cognizance is set aside. The petitioner is directed to file a protest petition before the learned Judicial Magistrate within a period of fifteen days (15) days from the date of receipt of of this order and on the receipt of fresh petition, the learned Judicial Magistrate is directed to conduct necessary enquiry and to pass orders in accordance with law. Consequently, connected miscellaneous petition is also closed."
4.Today, when the matter is being taken up, Mr.M.P.Senthil, learned Counsel for the petitioner submits that the learned Counsel, who was engaged before the trial Court, was admitted in the hospital due to some medical problem. Thus, the judgment and order passed by the Co-ordinate Bench of this Court, dated 13.02.2025 in Crl.R.C.(MD)No.1299 of 2024, was not complied with within the time and the 2/5
protest petition was also not filed, as per the time granted by this Court, vide order, dated 26.02.2025 ie., within 15 days. Thus, he submits that the petitioner has filed the present application for the relief stated supra. 5.It was further submitted by the learned Counsel for the petitioner that as a last chance, this Court may grant further time to the petitioner to file a protest petition before the Judicial Magistrate Court No.IV, Thoothukudi. 6.Mr.M.Karunanithi, learned Government Advocate (Crl.side) has no objection to allow this petition, by extending the time to comply with the conditions imposed by this Court in Crl.R.C.(MD)No.1299 of 2024 dated 26.02.2025. 7.
Accordingly, after considering the arguments, as advanced by the learned Counsel for the parties as well the grounds raised in the affidavit filed in support of this present petition, this Court is satisfied that the reason stated by the petitioner in the affidavit filed in support of this present petition appears to be justified. Thus, this Court grants one week and no more further time to the petitioner to file a protest petition before the Judicial Magistrate Court No.IV, Thoothukudi, without fail, in compliance of the order passed by the Co-ordinate Bench of this Court in Crl.R.C.(MD)No.1299 of 2024, dated 26.02.2025.
8.Rest of the conditions imposed in Crl.R.C.(MD)No.1299 of 2024, dated 26.02.2025 are unaltered.
9.With the aforesaid directions, this Criminal Miscellaneous Petition is finally disposed of.
