Prayer:- Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the first respondent to grant individual patta in the petitioner's name for the property in Survey No.111/1 an extent of 0.69.0 Ares in Patta No.907 in Poosalapuram Village, Peraiyur Taluk, Madurai District, by considering his revision petition dated 24.07.2025 within the period as stipulated by this Court.
For Petitioner : Mr.A.Haja Mohideen For R1 : Mrs.K.Malathi Additional Government Pleader
ORDER
The petitioner herein seeks a direction to the first respondent to issue patta in his name for the property in respect of the property situated in Survey No.111/1, Poosalapuram Village, Peraiyur Taluk, Madurai District, by considering his revision petition dated 24.07.2025. 2.Heard the arguments of Mr.A.Haja Mohideen, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional
Government Pleader appearing for the first respondent. Since no adverse order is passed against the respondents 2 to 11, notice to them is dispensed with.
3.By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
4.According to the petitioner, the subject property originally belonged to his paternal grandfather, Ponnaiah. He executed a Will dated 28.06.2019 bequeathing the subject property in favour of the petitioner and his mother, Mayilammal. The said Ponnaiah died in the year 2021. Thereafter, the patta was mutated in the name of the petitioner in Patta No.907. However, the names of the private respondents 2 to 11 have been erroneously included in the patta. Hence, the petitioner submitted a representation before the Revenue Officials on 01.08.2024. Based on this representation, an enquiry was conducted and a recommendation was made to issue patta in the name of the petitioner. Further, the petitioner was advised to submit a revision petition before the first respondent, since the error had occurred during UDR updation. Hence, the petitioner
filed a revision before the first respondent on 24.07.2025, seeking deletion of the private respondents' names and issuance of patta in his name. The same has not been considered. Hence, the petitioner has come before this Court.
5.The learned Additional Government Pleader appearing for the first respondent would submit that the revision filed by the petitioner will be considered in accordance with law.
6.In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to consider the revision filed by the petitioner dated 24.07.2025 and pass final orders on its own merits within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and private respondents 2 to 11. Accordingly, this Writ Petition is disposed of. No costs.
