PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the first respondent reinstate the petitioner at the last place of service as requested in the petitioner's representation dated 12.11.2019 and pass such further or other orders.

ORDER

The present writ petition is filed for a direction to the first respondent to reinstate the petitioner at the last place of service as requested in the her representation dated 12.11.2019.

2. The learned counsel appearing for the petitoner submitted that the petitioner was terminated from service due to conviction in the criminal case. Challenging the termination order, the petitioner has filed a writ petition in W.P.(MD)No.22042 of 2019. When the matter was taken up for hearing on 25.10.2019, both the counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents submitted that the order of conviction was set aside by this Court in Crl.R.C.(MD) No.443 of 2019, dated 18.10.2019. This Court, by the order dated 25.10.2019 directed the petitioner to give representation to the first respondent, enclosing the copy of the order dated 18.10.2019, https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.24110 of 2019 passed by this Court in Crl.R.C.(MD)No.443 of 2019, within a period of twelve weeks from the date of receipt of a copy of the order and directed the first respondent to consider the representation of the petitioner in the light of the order of this Court dated 18.10.2019, passed in Crl.R.C.(MD)No.443 of 2019.

3.The learned counsel appearing for the petitioner submitted that as per the order of this Court, the petitioner sent a representation to the second respondent but the second respondent prevented the petitioner from joining duty at the last served place. In the circumstances, she has come out with the present writ petition.

4. The learned Special Government Pleader appearing for the respondents submitted that as per the order of this Court, dated 25.10.2019, the petitioner's representation was considered and orders were passed reinstating the petitioner into service by the proceedings dated 08.11.2019 and issued posting order dated 12.11.2019, posting her to the Government Thanjavur Medical College Hospital in the existing vacancy.

5. Recording the said submission of the learned Special Government Pleader that petitioner was reinstated into service and issued posting order posting the petitioner in Government Thanjavur Medical College Hospital in the existing vacancy, the writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
