PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct the respondents 1 and 2 to appoint a competent police officer working under the respondent No.3 to investigate the case in Crime No.96 of 2016 registered on the file of the respondent No.7, and to file final report before the competent Court of law in accordance with law. ORDER
This Criminal Original Petition has been filed to direct the respondents 1 and 2 to appoint a competent police officer working under the respondent No.3 to investigate the case in Crime No.96 of 2016 registered on the file of the respondent No.7, and to file final report before the competent Court of law in accordance with law.
2.Today, when the matter is taken up for hearing the learned Government Advocate(Crl.Side) would submit that the seventh respondent police has completed the investigation in Crime No.96 of 2016 and they are about to file the charge sheet before the concerned jurisdictional Court and hence, at this stage transfer of investigation would not serve any purpose.
3.In the result, the Criminal Original Petition is dismissed, however the seventh respondent police is directed to file a final report before the concerned jurisdictional court within a period of eight weeks from the date of receipt of a copy of this order. Consequently connected miscellaneous petition is closed. However, the petitioner is at liberty to challenge the final report in the manner known to law.
