PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the 2nd respondent not to harass the petitioner under the guise of enquiry, on basis of the petitioner's complaint dated 20.09.2023.

ORDER

This Criminal Original Petition has been filed to direct the 2nd respondent not to harass the petitioner under the guise of enquiry, on basis of the petitioner's complaint dated 20.09.2023.

2. The learned Government Advocate (Crl.Side) would submit that the petitioner was issued with the fishing right of the Kanmoi belongs to Baganur village and total amount was fixed as Rs.3,40,000/-, in which, Rs.2,40,000/- was already paid by the petitioner and the remaining amount is not paid. Based upon which, the village persons have given a complaint against the petitioner and the same is pending, since he has not issued with the summons.

3. The learned counsel for the petitioner would submit that this petitioner is not involved in the above said fishing right issue. But, one another person by name Kunjumani is the lease holder .

4. Now whatever it may be, let the petitioner appear before the second respondent and co-operate with him to complete the process of 2/4

enquiry. Let the above said enquiry be completed within a period of fifteen days from the date of appearance of the parties. If any trouble arises during the course of enquiry, the petitioner can workout his remedy through appropriate proceedings.

5. With the above said directions and liberty, this Criminal Original Petition is disposed of.
