To admit this appeal and call for records and to set aside the conviction and sentence passed in Spl C.C.No.36 of 2014 on the file of the Learned Special Judge for Prevention of Corruption Act Cases, Madurai dated 11.09.2023 by allowing this criminal appeal.

SAHAYA PRABAHAR,Additional Public Prosecutor on behalf of the Respondent while admitting the Criminal Appeal the Court made the following order:- This petition is filed aggrieved by the judgment of the trial Court in Spl.C.C.No.36 of 2014, wherein finding the petitioner guilty of the offence under Sections 7 and 13 (2) r/w 13 (1) (d) of the Prevention of Corruption Act, 1988 and sentencing the petitioner to undergo three years rigorous imprisonment and a fine of Rs.1,000/- in default to undergo two months simple imprisonment for the offence under Section 7 of Prevention of Corruption Act, 1988 and four years rigorous imprisonment and a fine of Rs.1,000/- in default to undergo two months simple imprisonment for the offence under Section 13 (2) r/w 13 (1) (d) of the Prevention of Corruption Act, 1988.
2.Considering the submissions made by the learned counsel for the petitioner and on hearing of the learned Additional Public Prosecutor for the respondent, the sentence in Spl.C.C.No.36 of 2014 is suspended, pending appeal by imposing the following conditions:- (i)The petitioner shall execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, of whom, one should be a blood relative, each for a like sum to the satisfaction of the learned Special Judge for Prevention of Corruption Act Cases, Madurai.

(ii)The sureties shall affix their photographs and Left Thumb Impression in the surety bond and the trial Court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity; and (iii)The petitioner shall appear before the respondent police daily at 10.30 a.m and 5.30 p.m. until further orders.
