2.When the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondents submitted that already the case in Crime No.137 of 2017 was taken on file by the Judicial Magistrate, Tenkasi and assigned as CC No.336 of 2017 and hence, the matter has become infructuous. 3.The said fact is not disputed by the learned counsel appearing for the petitioner.
