ORDER

This Criminal Original Petition has been filed seeking for a direction to direct the first respondent police to execute the Non-Bailable Warrant issued by the Additional Mahila Court (Judicial Magistrate Level), Madurai on 31.10.2019 in C.C.No.222 of 2014.

2.The petitioner is the complainant in C.C.No.222 of 2014 which had taken cognizance for the offences under Sections 498(A), 406, 506(i) of IPC and Section 4 of Dowry Prohibition Act. There are totally three accused in this case, namely, the respondents 2 to 4 herein. The respondents 2 to 4 earlier filed Crl.O.P.(MD) No.12965 of 2019 before this Court and the same was disposed of on 18.09.2019. This Court directed the trial Court to complete the trial within a period of four months from the date of receipt of a copy of that order. Further, directed the respondents 2 to 4 to appear before the trial Court on all hearing dates without fail. After direction obtained by the respondents 2 to 4, they never appeared before the trial Court and as if the trial Court issued Non-Bailable Warrant as against the respondents/accused 2 to 4 on https://hcservices.ecourts.gov.in/hcservices/ 1/2

3.The learned counsel for the petitioner/de-facto complainant submitted that now the respondents 2 to 4 had gone to abroad and they did not appear before the trial Court.

4.Considering the facts and circumstance of the case, the first respondent is directed to execute the Non-Bailable Warrant issued as against the respondents 2 to 4 in C.C.No.222 of 2014 in the manner known to law within a period of eight weeks from the date of receipt of a copy of this order. The petitioner/de-facto complainant is also directed to co-operate with the first respondent to execute the Non-Bailable Warrant as against the respondents 2 to 4.

5.With the above direction, this Criminal Original Petition is disposed of.
