PRAYER :- For Bail in Crime No. 129 of 2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/Accused No.3 herein, who was arrested on 07.08.2023 for the alleged offence under Sections 489B, 489C, 420 of IPC, in Crime No.129 of 2023, on the file of the respondent police, seeks bail. 1/3

2.The case of the prosecution is that on 07.08.2023, the petitioner along with other accused persons went to the TASMAC shop and give one Rs.500/- currency note to the defacto complainant for buying liquor. The defacto complainant found that it is counterfeit currency. When the defacto complainant asked them to replace the above said currency note, they left the place without giving the original currency note. Hence, the complaint.

3.The learned Additional Public Prosecutor would submit that the petitioner is having one previous case, which is under 379 of IPC. 4.The petitioner was arrested on 07.08.2023 on the basis of the information of the first accused, who has been granted bail by the Principal District Judge in Crl.M.P.No.2657 of 2023, on the ground of physical disability. On that ground this petition has been filed. Even though the petitioner is in custody ever since from the date of arrest, considering the bad antecedents of the petitioner, this Court is not inclined to grant any discretionary relief. If the petitioner is released on bail, there is every likelihood to tampering the witnesses.
