Civil Miscellaneous Appeal Under Section 173 of Motor Vechile Act, to allow this appeal, set aside the award and decree made in MCOP.No.2 of 2020 dated 24-01-2022 on the file of the Motor Accident Claims Tribunal/Sub Court, Manamadurai.

CMP(MD) No.11974 of 2022 This petition is filed to permit the petitioners to withdraw 50% of the award amount with proportionate and Costs, deposited by the respondent / Transport Corporation to the credit of M.C.O.P.No. 2 of 2020 on the file of the Motor Accidents Claims Tribunal / Sub Court, Manamadurai.

2. It is submitted that in pursuance of the order passed by this Court, dated 26.07.2022 in CMP(MD).No.6313 of 2022 in CMA(MD). No.726 of 2022, the respondent / Transport Corporation has deposited 50% of the awarded amount with proportionate interest and costs before the Tribunal.

3. The learned counsel appearing for the respondent / Transport Corporation submits that the appeal is filed disputing the liability only for a amount of Rs.4,13,600/- and hence, he has no objection for withdrawal of the entire 50% amount deposited before the Tribunal.

4. In the light of the said submission, the petition for withdrawal of the amount is permitted.
