Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the sixth respondent to cancel the forgery documents registered by the 7th to 10th respondents based on the fourth respondent proceedings in Na.Ka.No. 1488/Aa1/2022 dated 03.11.2022 and consequently direct the respondents 1 to 6 to consider petitioner's representation dated 29.08.2023.

ORDER

Heard both sides.

2.The petitioner alleges that the property belonging to him was illegally sold by the ninth respondent. The eighth respondent came to eventually purchase the same.

3.The complaint given by the petitioner before the District Registrar, Ramanadhapuram was taken cognizance and proceedings were issued to the effect that the documents are forged and fabricated. The registering authority has also entered the said proceedings in the encumbrance register.

The petitioner has filed O.S.No.66 of 2021 on the file of Sub Court, Aruppukottai for cancelling the documents and also for granting compensation. Neyveli Lignite Corporation India Limited (NLC) is very much a party to the said suit.

4.When the petitioner has already invoked civil Court for relief, he 3/6

cannot parallelly move this Court. This writ petition is dismissed on that ground. However, taking note of the overall facts and circumstances, even while dismissing the writ petition, I direct the sub Judge, Aruppukottai to dispose of O.S.No.66 of 2021 on merits and in accordance with law within a period of twelve months from the date of receipt of a copy of this order.

5.This writ petition is dismissed with the aforesaid direction. There shall be no order as to costs.
