ORDER

It is stated that the petitioner is in possession and enjoyment of the property and that the property right of the petitioner is flown from the fourth respondent, who was now impleaded, stating that he is the tenant under the third respondent.

2. The learned counsel for the petitioner seeks permission of this Court to withdraw this petition and he has also made an endorsement to that effect.

3. Recording the endorsement made by the learned counsel for the petitioner, this Criminal Original Petition is dismissed as withdrawn and it is open to the petitioner or anyone, who is in lawful possession of the property, to approach the Civil Court for appropriate relief, if required.
