PRAYER : This Petition filed under Section 482 of Criminal Procedure Code to call for the First Information Report in Crime No.71 of 2013, on the file of the Inspector of Police, District Crime Branch, Dindigul District and quash the same.

ORDER
This Criminal Original Petition has been filed to quash the First Information Report in Crime No.71 of 2013, on the file of the Inspector of Police, District Crime Branch, Dindigul District. The petitioner is arrayed as accused No.1 in Crime No.71 of 2013 and he has been charged with for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
2. Today, when the matter was taken up for hearing, Mr.G.Thalaimutharasu, learned counsel appearing for the petitioner submitted that, now the petitioner has settled the amount to the second respondent / defacto complainant and the second respondent is also not interested in prosecuting the complaint. https://hcservices.ecourts.gov.in/hcservices/
3. The learned Additional Public Prosecutor appearing for
the first respondent, on instructions, submitted that this is a case of job rocketing and forgery. Totally there are three victims in this case. Now the investigation in this case is over and final report is also ready and only the pendency of the present petition, the respondent Police is not in a position to file a final report.
4. At this juncture, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw the Criminal Original Petition and made an endorsement to that effect.
5. In view of the endorsement so made by the learned counsel appearing for the petitioner, the Criminal Original Petition stands dismissed as withdrawn. However, the first respondent Police is directed to file a final report before the concerned Jurisdictional Magistrate within a period of three weeks from today. Consequently, the connected miscellaneous petition is closed.
