O R D E R

This Criminal Original Petition is filed seeking for a direction to quash the C.C No.559 of 2017 on the file of the Judicial Magistrate, Alangulam, Tirunelveli, against the petitioner/A8 2.According to the prosecution, on 25.09.2015 due to previous motive, all the accused joined together and abused the de-facto complainant in front of O.Thulukapatti Narayanasamy Temple and also threatened her with dire consequences.

3.The learned counsel appearing for the petitioner submitted that the First Information Report and the Charge Sheet do not disclose any offence as against the petitioner and the petitioner is no way connected with both the families, either by caste or any other relationship and no specific overtact has been attributed as against this petitioner. At this juncture, now the learned counsel for the petitioner submitted before this court that the petitioner is willing to conduct the case before the trial court and hence, a direction may be issued to the trial court to dispose of the case within a short space of time.

4.Heard the learned Government Advocate (Criminal side) appearing for the 1st respondent/State as well as the learned counsel appearing for the 2nd respondent/defacto complainant. 5.Keeping in view the above facts and also considering the submission made by the learned counsel appearing for the petitioner, this criminal original petition is disposed of with a direction to the trial court namely the Judicial Magistrate, Alangulam, Tirunelveli District, to post the case in CC No.559 of 2017 on day today basis and dispose of the same purely on merits and in accordance with law, within a period of three months from the date of receipt of a copy of this order. Consequently, connected Miscellaneous Petition is closed.
