ORDER

The instant writ petition has been filed by a Junior Assistant working in the Panchayat Union Office, seeking a mandamus to direct the respondents to sanction medical leave for a period of 248 days and calculate the salary and other benefits by considering his representation dated 30.09.2024. 2.It could be seen from the records that the petitioner has availed medical leave in two spells between 19.09.2019 to 10.10.2019 and 11.10.2019 to 30.11.2019. However, when he attempted to rejoin duty, the department had directed him to appear before the Medical Board by way of proceedings dated 10.02.2022. But, the petitioner has not appeared before the Medical Board. Now the petitioner has approached this Court seeking for sanction of the medical leave.

The writ petition is bereft of any details about the fact whether the petitioner has submitted his fitness certificate before rejoining the duty or the medial leave was already regularised by the department or not. 3.In view of the above said facts, the respondent herein is directed to consider the representation of the writ petitioner and pass orders on merits in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

4.With the above said observations, this writ petition stands disposed of. No costs.
