Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the respondents to speedy disposal of the petitioner's petition dated 08.07.2024 for issuing a patta at Survey No.331/5 in Pattinamkathan Revenue Village, Ramanathapuram Taluka, Ramanathapuram District pending before the first respondent in view of the proceedings of the first respondent in A6/4870/2024 dated 16.07.2024 within a time to be stipulated by this Court.

ORDER

The petitioner had purchased a property measuring an extent of 3 cents in S.No.331/5, Pattinamkathan Revenue Village, Ramanathapuram Taluk, Ramanathapuram District under a registered sale deed dated 11.02.2005 from one Maimmon Beevi and his mother having purchased an extent of 2.5 cents from the said Maimmon Beevi through her Power Agent, he and his mother were in possession of the entire extent. The petitioner had made an application dated 26.02.2024 for issue of separate patta. This application was rejected by the Tahsildar, Ramanathapuram citing the reason of area error, but the Tahsildar had neither granted the patta, nor communicated the decision taken. The petitioner once again renewed the request. When the petitioner had approached Surveyor and Village Administrative Officer for survey of land in order to subdivide the same, he came to know that the computer patta stood in the name of the Housing Board. Therefore, he made a petition dated 08.07.2024 to remove the name of the Housing Board from the patta and the same has

not been processed. Therefore, aggrieved by this, the petitioner is before this Court.

2. Heard the learned counsel on either side.

3. The petitioner and his mother had purchased an extent of 5.5 cents in S.No.331/5. The representation for patta ought to be disposed of within a period of thirty days. Though the application has been made on 08.07.2024, the application has not even been taken up for scrutiny. Therefore, a mandamus is issued to the respondents to dispose of the application dated 08.07.2024 and pass orders within a period of eight weeks from the date of receipt of a copy of this order.

4. With the above direction, this Writ Petition is allowed. No costs.
