For Respondent : Mr.Antony Sahaya Prabahar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.44 of 2022 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/A4, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406 and 420 IPC, in Crime No.44 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that the defacto complainant is the owner of the JCB. The petitioner/A1 took the JCB from the defacto complainant for monthly rent. But he did not pay the rent and did not return the JCB. Thereafter, the defacto complainant came to know that the petitioner sold the JCB to the some other persons. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. Hence, he seeks anticipatory bail. https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.19837 of 2022 4.The learned Additional Public Prosecutor would submit that totally four accused involved in this case and this petitioner is the fourth accused. He would further submit that in this case, the investigation is preliminary stage and the custodial interrogation is necessary. Hence, he strongly opposed to grant anticipatory bail.
5.Considering the facts and circumstances of the case and also considering the gravity of the offence, this Court is of the view that custodial interrogation is necessary in this case. Hence, this Criminal Original Petition is dismissed.
