For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.9/2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under sections 294(b), 323, 341, 506(ii), 509 IPC and Sections 7,8,9(1), 10, 15(1) of Protection of Child from Sexual Offences Act, 2012 and Section 67B (a) of Information Technology (Amendment) Act, 2008 in Crime No. 9 of 2022 on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that A1 and A2 had sexually assaulted the defacto complainant for the past one year, when the same was questioned by the defacto complainant's father, the https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.19813 of 2022 petitioners who are the family members of A1 and A2 have attacked him and also abused in filthy language. Hence, the compliant. 3.The learned counsel appearing for the petitioners would submit that the petitioners are innocent and they have not committed any offence as alleged by the prosecution and their names have been falsely implicated in this case.

4.The learned Government Advocate (Crl. Side) appearing for the respondent would submit that A1 and A2 have sexually assaulted the defacto complainant, when the same was questioned by defacto complainant's father, the accused persons have attacked him and also abused in filthy language. He would further submit that 164 statement of the victim was recorded and the investigation of the case is pending and he strongly opposed to grant anticipatory bail to the petitioners.

5.Considering the submission made by the learned Government Advocate (Crl. Side) appearing for the respondent and also considering the serious nature of allegations made against the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners.
