ORDER : The Court made the following order :- The petitioner/A1, who was arrested and remanded to judicial custody on 1/4

12.08.2024 for the offence punishable under Section 387,506(ii) of IPC @ 120(B), 392,397,148 and 149 of IPC in Crime No.152 of 2024 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the accused persons have conspired together with deadly weapons, threatened the defacto complainant and others and committed dacoity of cash of Rs.19,50,000/- and three cellphones from the defacto complainant. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him. He would further submit that the petitioner was arrested on 12.08.2024. He would further submit that co-accused was released on bail and major part of the investigation is over, hence he seeks bail.

4. The learned Additional Public Prosecutor would submit that there are totally 13 accused in this case and the petitioner herein is arrayed as A1. He would further submit that the accused persons have committed robbery of Rs.19,50,000/- and only part amount has been recovered. He would further submit that the petitioner is having 10 previous cases and he is a history sheeted rowdy element and some of the accused are still absconding, hence he objected to grant bail to the petitioner.

5. Taking into consideration the fact and circumstance of the case and also the 2/4

fact that only part amount has been recovered and remaining amount has to be recovered and the fact that the petitioner is having 10 previous cases and he is a history sheeter and also the fact that some of the accused are still absconding, this Court is not inclined to grant bail to the petitioner.

6. Hence the petition stands dismissed.
